Claus Thiery advises and represents his clients in D&O liability and compliance cases as well as in complex commercial, corporate and insolvency-related disputes, mainly in a cross-border context and with special expertise in e-discovery, US trials and specific Middle East know-how. Formerly a regional court judge, he is a highly experienced litigator in lawsuits before the ordinary courts as well as an arbitration and out-of-court dispute resolution expert. In this context, Claus has long-standing experience in handling IT and large-scale claims.

He also acts as ombudsman for large groups, as witness adviser in, e.g., parliamentary inquiries and as mediator in complex IT and corporate disputes. Leading law firm guides frequently recommend him as a very skilful and thoughtful negotiator.

Claus joined CMS in 2002. He previously served as a judge at Konstanz Regional Court and qualified as a certified lawyer for insolvency law as well as a commercial mediator. In 2005, he worked in the dispute resolution practice of a major US law firm in Atlanta and New York.

The collective action for redress that became available in October last year extends the options for collective legal action in Germany. For the first time, consumers and small businesses can take collective action against companies for redress and obtain a direct remedy, such as payments. The existing model declaratory action can only be used to obtain declaratory decisions, in other words it does not lead to a title of execution. In this podcast, Claus Thiery and Sandra Renschke, partner and counsel in the Dispute Resolution practice respectively, explain aspects such as how the remedial procedure is structured, what role consumer associations play and to what extent settlements are a likely outcome.
