Kira Falter advises national and international companies on individual and collective employment law. Her main focus of her advice covers all issues relating to the legally compliant use of external staff, i.e. distinguishing between contracts for work and service contracts on the one hand and (illegal) temporary agency work on the other, as well as the engagement of freelancers. Kira Falter supports and advises her clients in particular on the implementation of compliant structures, their representation before regulatory authorities and in court and the drafting of the relevant contracts. Audits and mock dawn raids in this area are also in her area of expertise. In addition, she regularly advises on organising external staff in agile working methods (such as scrums). She played a key role in the development of the CMS product FPE (External Staff Deployment), an IT-based legal tech solution that provides clients with a fast and reliable initial assessment for the deployment of external staff, and is a member of our Compliance Excellence Team.
Another key focus of her work is gender pay gap transparency as well as the (flexible) organisation of working hours and other terms of employment.
She regularly handles unfair dismissal cases and procedures for resolving disputes between employers and works councils; her expertise also extends to workplace reorganisations.
Kira Falter has been a lawyer at CMS since 2013 and a specialist in employment law since 2017. She was appointed partner at the start of 2021.
