Martin Gerecke specialises in new media law and e-commerce, advising companies and individuals in the media, communications and technology sector on domain and internet law as well as on all legal aspects of social media, games and digital media. He assesses, protects and defends the content of (online) publications of all kinds, helps artists, agencies and publishers to protect their IP and advises companies on the acquisition and exploitation of licensing rights for media use. In contentious cases, he also takes over litigation.
Martin also has expert know-how in the event, festival and ticketing sector. Organisers of (major) events regularly entrust him with drafting and negotiating organiser contracts, agency contracts and festival contracts.
Martin has long-standing experience in drafting and negotiating complex media-specific contracts such as licensing, agency, advertising or artist agreements in TV and film, marketing, sports and online. He is also experienced in all questions of media regulation.
In addition, Martin focusses on drafting e-commerce contracts, advising online platform operators and e-commerce providers, among other things, on the rights and obligations arising from the EU Directive 2019/771 on aspects concerning contracts for the sale of goods, (fake) internet ratings or the limits of misleading advertising (online advertising).
Martin joined CMS in 2014 after three years with a Hamburg copyright and media law boutique firm and was made partner in 2022. He lectures at the University of Kiel and regularly publishes on media and online law.
