During a webinar on 24 September 2020, our experts discussed claiming under a W&I policy and possible challenges in that regard. The webinar touched upon the most important topics of both the transactional side and the claims side of W&I policies. The webinar had a lot of attendees and was praised as interesting and useful, particularly for the best practice recommendations provided by the speakers.
Mark Ziekman and Herman Boersen kicked off by briefly introducing W&I insurance and discussing the current trends in the transaction (underwriting) process. Oskar van de Weijer elaborated on the correlation between an SPA and a W&I policy and the interpretation issues that may arise.
Remko van Baarlen analysed the disclosure under a SPA and the importance of this item in relation to claims under a W&I policy. Leonard Böhmer discussed ‘Loss’ under a W&I policy. He set out how this difficult subject often leads to discussions in practice and illustrated this by two catchy examples.
