The new law introduced essentially three new tools, one which qualifies as a second merger control screening by the EU, a second which introduces new requirements for public tenders and a third that enabling the European Commission to initiate ex-officio investigations into individual cases against third country subsidies.
The FSR also provides companies active in the EU with more options to file complaints against competitors receiving third country subsidies that effect the EU market, but it also creates new obstacles for many companies from outside the EU and it will lead to additional regulatory requirements for companies, even to those with EU headquarters.
