Who is liable when extraordinary intolerance to a therapy arises?

The Supreme Court ruled in a recent decision that the hospital or doctor carrying out the treatment is also responsible for the consequences of an extraordinary and unforeseeable intolerance to a therapy, if this therapy was made necessary by medical malpractice.
