Change of courts for Nullity claims in Industrial Property

Among the modifications that are implemented by the reform to the Code of Administrative Procedure and Administrative Litigation (CPACA), there is a change in the Judge that hears Nullity claims in Industrial Property.

On January 25, 2021, the Congress of the Republic of Colombia issued Law No. 2080 by which the CPACA is reformed, which modifies in its Article 28 the jurisdiction of the Administrative Courts, including those related to Industrial Property.

As a result, Nullity claims relating to Industrial Property rights which were previously known by the Council of State, will now be the exclusive competence of the First Section of the Administrative Court of Cundinamarca.

The application of this Law with regard to the change of jurisdiction of the administrative courts for Nullity claims related to Industrial Property rights, in accordance with the provisions of Article 86, will begin on January 26, 2022.
