Although most of the recent amendments to the Transfer of Undertakings (Protection of Employment) Regulations 2006 ("TUPE") applied in relation to transfers taking place on or after 31 January 2014, there were a couple of exceptions to this.
Notably in relation to TUPE transfers occurringon or after 1 May 2014,the transferor will be obliged to provide to the transferee "employee liability information" at least 28 days before the transfer - an increase from 14 days.
Employee liability information, which is prescribed by TUPE, identifies the employees who are to transfer and includes certain details about their employment. Compensation may be payable by the transferor to the transferee where it fails to comply with the provisions relating to employee liability information.
