Ben is Of Counsel in the Dispute Resolution Team at CMS Manchester.

During his career Ben has advised on some of the largest development and regeneration projects in the UK. With over 10 years’ experience in real estate solutions/disputes, Ben regularly advises on all aspects of commercial property disputes including telecommunications, contractual disputes, rights of way / proprietary rights disputes, forfeiture, restrictive covenants, lease renewal claims (for both landlord's and tenant's), break notices and dilapidations.

Ben has a particular expertise in relation to disputes in a development context, with a solutions driven approach to resolving development constraints. He is also recognised as being a specialist in rights of light matters. Ben has acted for a wide range of clients, including developers (both residential and commercial), investors, hotel operators, landlords, tenants and public bodies. 

Relevant experience

  • The lead real estate advisor to a US based, multinational corporation across its portfolio of UK and European resorts.
  • Complex rights of light risk analysis reports and proposed strategy for some of the largest development schemes in the UK and the implementation of the proposed strategies thereafter.
  • On the defence of a developer client in relation to an alleged breach of a development agreement relating to a site in Birmingham with a claim value in excess of GBP 10m involving multiple parties and freezing injunctions.
  • On behalf of a national house builder client following the issue of proceedings by an adjoining landowner for an alleged breach of proprietary rights in connection with its residential development.
  • Strategic advice to a major UK property investor across its GBP 400m portfolio of UK assets on all aspects of commercial property disputes.
