Gordon is a dual qualified Associate specialising in Real Estate Disputes in Scotland and England & Wales.

Gordon has a broad range of experience in commercial Real Estate Disputes across Scotland and England & Wales, including landlord and tenant disputes (such as dilapidations and the recovery of arrears), wayleave and servitude disputes, lease termination advice and vacant possession strategy, and general property litigation. He is well placed to advise clients operating in both jurisdictions and help them navigate the procedural and substantive differences between Scots law and English law in Real Estate Disputes.

He also has experience in residential disputes in England & Wales, including leasehold enfranchisement, right to management claims, and landlord and tenant matters.

Gordon acts for institutional investors, corporate occupiers, and energy companies. He has experience with Scottish cases in the Sheriff Courts, the Court of Session, and the Lands Tribunal for Scotland. He also has experience of English cases in the County Court, the High Court, and the First-tier Tribunal (Property Chamber). He regularly works closely with leading Advocates in Scotland and leading Barristers in England & Wales. Gordon also has experience of mediation and arbitration as alternative forms of dispute resolution.

Gordon has an interest in ESG and, in particular, its impact on dispute resolution in the real estate sector.

Relevant experience

  • A national energy company in defending a GBP 14m claim for compensation in the Lands Tribunal for Scotland under the Electricity Act 1989 arising out a necessary wayleave.  
  • Institutional investors on a range retail and mixed-use developments, including recovery of rent and service charge, dilapidations, 1954 renewals/tacit relocation disputes, forfeiture/irritancy, enforcement of obligations and covenants, and removal of unauthorised occupiers.
  • An institutional investor in an application to the Lands Tribunal for Scotland to successfully remove a historic title restriction in a retail park to allow regeneration of the retail park.
