New Hungarian Government Competence Decree: FDI Implications

The government has adopted Government Decree 90/2026 (V. 13.) on the responsibilities and competences of the members of the Government (the "Government Decree”) reassigning ministerial portfolios and competences. The Government Decree has entered into force on 14 May 2026 (link: Hungarian Gazette No. 46).
Of practical significance for FDI-related matters, the Government Decree confirms that:
- the Minister of Economy and Energy (István Kapitány) is the minister responsible for the domestic economy, meaning that notifications of transactions under Act L of 2025 of Hungary on the elevation to statutory level of emergency decrees issued in view of the armed conflict in Ukraine must be filed with this minister instead of Márton Nagy, the now former Minister of National Economy; and
- the Minister of Interior (Gábor Pósfai) is the minister responsible for directing the civilian national security services, meaning that notifications of transactions under Act LVII of 2018 controlling foreign investments violating Hungary’s security interests must be filed with this minister, instead of Antal Rogán, the now former Minister of the Prime Minister's Cabinet Office.
All planned FDI transactions in Hungary are affected: to avoid complications in the notification process, it must be ensured that FDI-filings are directed to the Minister of Economy and Energy (filings made under Act L of 2025) or the Minister of Interior (filings made under Act LVII of 2018), respectively.
