Philippe Heinzke specialises in IP, IT and data protection law, with a focus on copyright and licensing. He also prepares and negotiates IT project and outsourcing agreements. His data protection practice concentrates on international data transfer between affiliate companies. Philippe furthermore advises on IT compliance matters, in particular on all aspects of open source compliance.

After co-founding and working for a number of software development and e-commerce start-ups, Philippe joined CMS in 2013 and in 2015, was seconded to Hewlett Packard Enterprises, working on IT outsourcing projects. His trainee lawyer period focused on IP and IT law and included placements at the Ministry of Economics and Technology and Deutsche Telekom AG. He was made counsel in 2019.

In a re­cent de­cision that could have leg­al im­plic­a­tions on the use of open-source soft­ware in China, the Beijing In­tel­lec­tu­al Prop­erty Court (BIPC) used a con­tro­ver­sial test to de­term­ine wheth­er soft­ware de­veloper YouZi in­fringed on copy­right or simply ex­ploited.
