Directive 2014/91/EU (“UCITS V”) came into force on 17 September 2014 and makes certain changes to the 2009 recast UCITS Directive. UCITS V must be transposed into UK law by 18 March 2016. A key part of UCITS V is to update the provisions on the depositary regime so that UCITS are afforded better asset protection than AIFs.
As part of the seminar we will provide an overview of the requirements of UCITS V and the FCA’s proposals for its transposition into UK law, and in particular, where UCITS V differs from the applicable provisions under the AIFMD.
Topics to be covered include:
- The FCA’s approach to implementation.
- Changes to the Depositary Regime.
- Remuneration rules imposed on UCITS management companies.
- Fund documentation amendments.
