Parental Responsibility: class actions brought in England for activities of overseas subsidiaries and suppliers

In today’s global world, those impacted by a group’s overseas operations are increasingly seeking to bring claims in England against the group parent or the company at the head of the supply chain.  Managing the risk of such claims raises difficult questions of corporate responsibility and strategy.

In this session, our expert panel will:

  • Provide an overview of recent developments in case law in this area, looking at the factors the court will consider when determining if it has jurisdiction to hear claims for transnational torts 
  • Look ahead to what these developments may mean for the future: with increasing trends towards group-wide ESG commitments, will risk of liability increase?
  • Consider whether it is realistic for companies to protect themselves against such claims, and if so, how: or is parent company liability now all but inevitable?
