Regulatory control of BT and Kingston for wholesale broadband access
Oftel has published proposals to impose regulatory controls on BT in relation to wholesale broadband access. Oftel identifies three wholesale markets for broadband access in the UK, (a) asymmetric broadband origination in the UK excluding the Hull area; (b) asymmetric broadband origination in the Hull area; and (c) broadband conveyance in the UK.
Oftel finds that BT has Significant Market Power (SMP) for asymmetric broadband origination in the UK excluding the Hull area and broadband conveyance in the UK and that Kingston has SMP in asymmetric broadband origination in the Hull area.
The following regulatory requirements are proposed for BT:
- to provide Network Access on reasonable request;
- not to unduly discriminate;
- to publish a reference offer;
- to notify terms and conditions;
- to notify technical information;
- to provide quality of service information;
- to establish a statement of requirements for new access;
- to have accounting separation; and
- to provide Asynchronous Transfer Mode (ATM) interconnection on a retail minus basis.
The following regulatory requirements are proposed for Kingston:
- to provide Network Access on reasonable request;
- not to unduly discriminate;
- to publish a reference offer;
- to notify terms and conditions;
- to notify technical information; and
- to have accounting separation
