CMS acts for Truman Brewery on successful defence in Supreme Court against judicial review challenge
CMS has advised the Truman Brewery on its successful defence in the Supreme Court against a judicial review challenge brought by Spitalfields Trust. The challenge was made against the planning permission granted by Tower Hamlets for mixed-use development on a vacant part of the Truman Brewery estate on Brick Lane.
The permission has been upheld and will provide for flexible workspace, small shops and restaurants, a gym, wider pavements to Brick Lane and Woodseer Street, and a new public square. The Truman Brewery will continue to manage the development site alongside the existing creative and commercial hub that has successfully evolved on the estate over the past 30 years.
Ashley Damiral, Head of Planning at CMS UK, comments: “We are delighted to have advised the Truman Brewery on this positive outcome. The development will create a local asset from an otherwise unproductive space and will help generate over 400 new jobs. The CMS Planning team is expertly placed to advise across the full development lifecycle. We have a track record of successfully supporting clients on appeals and call-in public inquiries, as well as situations like this where a judicial review reaches the Supreme Court.”
The Truman Brewery, adds: “We’re delighted with this outcome, and we’d like to thank the CMS team for their invaluable support throughout the process. We welcome the opportunity to progress plans to develop a mixed-use destination on a vacant part of the Truman Brewery estate. This will complement the creative and small business focus of the wider Truman Brewery estate, allowing us to create more of the same.”
The CMS team was led by partner Ashley Damiral and included Gael Hardie and Roisin Laycock (Planning).
CMS has one of the largest planning teams in the UK with over 40 specialist lawyers. The team works across the full range of development and infrastructure sectors, including urban regeneration, housing, retail, data centres, industrial and logistics, hotels and leisure, surplus land and energy and infrastructure.
