Alex is a Senior Associate in the Financial Services Regulatory team at CMS. He advises clients on a range of contentious and non-contentious matters.

Alex joined CMS in 2022 having worked as a Manager/Senior Manager in EY’s FS Legal team for five years and, prior to that, an Associate Lawyer in the FCA’s enforcement division for over seven years. 

Alex has in-depth knowledge and expertise in relation to regulatory enforcement investigations involving firms and individuals, and covering matters such as governance and systems and controls failings, poor customer treatment, and AML failings. Alex has experience of the various stages of the lifecycle of an investigation, including Skilled Person appointments, consumer redress programmes and whistleblowing.

Alex has advised clients in both retail and wholesale sectors on a wide range of non-contentious regulatory matters, including perimeter related advice, compliance with FCA Handbook/PRA Rulebook requirements, FCA authorisation applications, updates to firms’ policies and procedures to reflect the latest regulatory requirements, Brexit-related gap analyses and compliance with UK sanctions laws.  

Relevant experience

  • Representing firms and individuals under FCA enforcement investigation, providing advice and support throughout the enforcement process
  • Advising an unregulated property development firm on whether it has been carrying out regulated activities
  • Advising an overseas bank on the scope of services it will be able to carry out in the UK on a cross-border basis if it leaves the Temporary Permissions Regime without becoming authorised in the UK
  • Advising the provider of independent trustee and depositary services on requirements impacting the firm in respect of UK sanctions laws
  • Providing advice and guidance to a start-up Fintech firm on its application to the FCA to be authorised as a MiFID investment firm
  • Carrying out regulatory due diligence on a corporate transaction for a client firm involving its acquisition of an insurance underwriting business 
  • Advising a wealth management firm on a potential restructuring involving it falling outside of the scope of MIFIDPRU requirements and updating its standard client agreement
  • Assisting the London Branch of an overseas bank in reviewing and updating its MiFID related policy documentation (client categorisation, best execution policies etc) to reflect UK MiFID/MiFIR requirements post-Brexit 
  • Reviewing the terms and conditions provided by a fitness and health centre to customers to determine whether its customer contract falls within the scope of the consumer credit regime requiring FCA authorisation
  • Assisting a retail firm on its application for a new director to be authorised by the FCA as a Senior Manager
