Fiona is a Senior Associate in the dispute resolution team. Her practice focuses on real estate disputes in Scotland.

She has experience of acting for clients in the Court of Session and the Lands Tribunal for Scotland, and has regularly appeared in sheriff courts across Scotland.

Prior to joining CMS, Fiona gained experience in insolvency, finance and commercial litigation matters, acting on behalf of private and public sector clients.

Relevant experience

  • A major telecoms infrastructure provider in some of the leading Scottish cases arising from the Electronic Communications Code.
  • Handling contentious portfolio management issues for one of Scotland’s largest independent property asset managers, including recovery of rent and service charge, dilapidations, tacit relocation disputes, irritancy and removal of unauthorised occupiers.
  • Secured lenders in relation to the calling up of standard securities and recovery of possession of commercial and residential properties.
  • A landlord in claim for damages against neighbouring proprietors following damage caused by building works.
  • A major retailer in respect of encroachment claim.
