Megan is an Associate in the Tech, Media and Intellectual Property team at CMS, based in Edinburgh. Megan has expertise in both contentious and non-contentious matters.

Megan’s non-contentious experience includes drafting and negotiating a wide range of commercial contracts, intellectual property agreements and data protection documentation, as well as assisting with M&A transactions. On the contentious side, Megan has extensive experience working on a range of copyright, passing off, trade mark, patent and design disputes. This includes matters before the Court of Session (Scotland’s highest civil court) and the Company Names Tribunal.

In her role at CMS, Megan works with clients across a variety of different sectors and locations. She has advised large consumer-facing businesses, tech companies, small start-ups, public sector entities and universities.

Relevant experience

  • One of the world’s largest technology companies in respect of an online infringer selling counterfeit products which resulted in court orders being awarded against the infringer including final interdicts (injunctions) and a seven figure damages claim.
  • A large oil and gas operator services company in the successful defence of a claim brought by a licensor involving the alleged misappropriation of various IP in a claim purportedly valued at over GBP 100m.
  • A robotics company in respect of the pursuit of patent infringement claims brought by the company in Scotland and the defence of IP infringement claims brought in Italy.  
  • A third sector renewable energy organisation in relation to the creation of a multi-stakeholder database with a complex licensing structure.
  • Various consumer-facing businesses with various commercial contracts, website and product terms and data protection policies.
  • Various university clients in respect of spin out companies and commercialisation of intellectual property, with intellectual property licences and revenue sharing.
  • Various lifesciences clients in respect of various IP and services agreements.
