Highlights of our Ports experience

  • Harbour Redevelopment on delays due to COVID-19 on complex marine dredging and civil works in a major harbour redevelopment project. Also advising on a number of complex and high value claims against both the Employer and Subcontractors - adjudications, negotiation and civil litigation in Scotland and England.  
  • Port of Tyne in relation to the construction and operation of a new £180 million biomass handling facility at the Ports of Tyne, being developed jointly by Port of Tyne and its JV Partner Equitix. The facility will handle importation and onward transit of biomass fuel for large coal-fired power stations in the North East of England that are converting to biomass. 
  • Port of Tyne as part of the Equinor/SSE JV on the drafting and agreement of a Port Services agreement with the Port of Tyne permitting the docking (and subsequent loading/unloading) of service operation vessels as part of their support of the offshore Dogger Bank Windfarm development. Portsmouth International Port    Advising on a dock redevelopment scheme, including commercial and other properties, whilst maintaining port facilities for local shipping and visiting leisure-related vessels.
  • London Thamesport on the development by way of expansion of an existing port at Thamesport, Medway and the granting of leases on the Thamesport site to customers of the port for specialist operations there.
  • Felixstowe South and Bathside Bay - the Strategic Rail Authority on agreements with Hutchison Ports for Felixstowe South and Bathside Bay in relation to the enhancement of freight lines associated with the port development. Also advising on specialist rating issues in relation to Felixstowe port.
  • Hutchison Ports Holdings - both the Hong Kong parent and the UK and European businesses on a variety of European and UK merger control, competition and procurement issues.  
  • Port of Newhaven on the redevelopment of the Port of Newhaven and the subsequent disposal of the Port Authority.
  • Harbour authorities on multiple entities on port facility security requirements, statutory processes and tug / towage issues.
  • Lerwick Port Authority on provision of a development funding package (alongside existing grant funding) to Lerwick Port Authority, to facilitate the provision of deeper berthing, an offshore decommissioning yard and new fishing market, and the deepening of the quay.
  • Orkney Harbours - Orkney Islands Council on a range of harbour services being provided to the offshore industry: involved maritime / commercial advice, environmental, vires and state aid issues, and analysis of existing lease provisions.
  • Scottish Government  on restructuring of port-owning company; prepared harbour access contracts and charter parties; advised on public procurement of ferry & harbour services including negotiation of public service contract and grant funding.
  • Hull Port - Associated British Ports on the development of a major container port facility and related infrastructure at Hull.
  • Norfolk - Environment Agency on a dispute with a contractor for the construction of sea defence works.
  • Royal Albert Dock on development documentation with Development Securities plc for the phased development of the Royal Business Park at the Royal Albert Dock, the ExCel Conference Centre at the Royal Docks in London.
  • Shell Haven Terminal on the negotiations with promoters of scheme for new port and business park, Shell Haven, including objections to planning application and Transport and Works Act Orders and negotiating compromise Agreements.
  • River Clyde development - Renfrewshire Council on various infrastructure projects being promoted as part of the Glasgow City Region City Deal. This has included successfully promoting the Renfrewshire Council (White Cart Water Navigation) Harbour Revision Order 2018; and on the interaction with Clydeport, as port authority, arising from a proposed opening bridge to be constructed across the River Clyde. 
  • Wick Harbour - SSE on the works to Wick Harbour, including permitted development rights, marine licences and consents from the Wick Harbour Authority.
  • Hastings Port -  the Borough of Hastings on the proposed development of Hastings Port, including on the provision of rail access to the port.
  • PD Ports on the purchase of PD Ports as part of the £1.1bn recapitalisation of Babcock & Brown Infrastructure.
  • Medway Ports - the lenders to the winning bidder on the privatisation and redevelopment of the Medway Ports.
  • Port of Tilbury - a consortium on its acquisition of the port.
