The theme of the ICCA is “Arbitration’s Age of Enlightenment?” John Locke, as one of the leading Enlightenment thinkers, was the primary author in 1698 of the first Arbitration Act and would we are sure have been delighted to see practitioners from around the world gathering in Edinburgh in 2022 to debate the interaction between these 2 areas that engaged him over 300 years ago. It was Locke who, in drafting that Act which is the forerunner of our modern arbitration legislation, recognised that it was vital to effective trade that we have a place a system which protects arbitration agreements and permits effective enforcement of arbitration awards, still two of the cornerstones of modern arbitration practice today.

To mark the influence of Locke and his contemporaries, we have taken inspiration from nine Enlightenment thinkers to create a series of articles from nine different CMS offices, each discussing a current arbitration issue.
