Medical devices

The medical device field covers a wide range of technologies, from diagnostic tools to delivery instruments. Some medical devices themselves can even be considered as ‘borderline’ pharmaceuticals. This range creates many different legal challenges, from patentability to regulatory considerations.

Our team has scientific expertise and experience across this field, including work on intragastric balloons, wound healing devices, diagnostic imaging techniques and dry-powder inhalers. We understand the importance of careful claim drafting and prosecution strategies to deal with the nuanced patentability requirements of the EPC and UKPA in this field.

Our wider Life Science team at CMS includes lawyers who specialise in MedTech, with regulatory, compliance and liability expertise.  This puts our team in a unique position where we can understand and advise on the full life cycle of a medical device, from R&D through to post-market compliance.
