Health represents by far the biggest area of government procurement spending.

The NHS is made up of a complex patchwork of organisations, though much of the procurement is conducted centrally under different forms of framework agreement.

There are two key legislative measures relevant to authorities and to suppliers in this sector. There is a specific set of rules, set out in the NHS Provider Selection Regime (PSR), for the procurement of certain healthcare services. The PSR replaces principles of competition with a new system of collaboration and partnering. The PSR sits outside of the new Procurement Act.

All other NHS procurement is subject to the Procurement Act. Specific features of the Act that are particularly relevant to healthcare procurement include: the scope of the ‘light touch regime’; new rules on frameworks and ‘dynamic markets’; debarment and exclusion; contract management and modifications; transparency rules including the publication of different forms of notices.
