HMT: The Over the Counter Derivatives (Intragroup Transactions) Regulations 2026 (Draft)/ FCA: CP25/30: Streamlining the UK EMIR Intragroup Regime
HMT has published a draft SI for technical comment, alongside an accompanying policy note. As well as making the exemptions currently provided for in the temporary intragroup exemption regime permanent, the SI also looks to streamline the intragroup exemption process. To support HMT’s proposals in its draft SI, FCA proposes to further streamline the Intragroup Regime, simplifying and consolidating the Binding Technical Standards, and making consequential amendments to align with changes being made to UK EMIR. Responses to both the draft SI and consultation are required by 16 January 2026.
