AI regulation in your jurisdiction

There is currently no dedicated AI law in force in Mexico.

Existing Regulatory Frameworks Applicable to AI

Laws that govern activities that may have an AI impact:

  • Federal Law on Protection of Personal Data Held by Private Parties (LFPDPPP)
    Governs the processing of personal data by private entities, including automated decision-making and AI applications.
  • General Law on Protection of Personal Data in Possession of Obligated Subjects
    Applies to public sector entities using AI systems.
  • Federal Consumer Protection Law
    Ensures transparency and fairness in services offered to consumers, including those involving AI-driven decisions.
  • Cybersecurity and Digital Services Regulations
    While Mexico lacks a unified cybersecurity law, sectoral rules may apply to digital platforms and AI systems in critical infrastructure.
  • Financial Sector Regulations (CNBV Guidelines)
    AI used in financial services (e.g., credit scoring, algorithmic trading) is indirectly regulated through risk management and transparency obligations under applicable financial regulation.
  • Intellectual Property and Copyright Laws
    Apply to AI-generated works and training datasets.

Regulatory Oversight of AI

No single AI regulator. Oversight is fragmented depending on the corresponding area which amongst others are:

  • Ministry of Anticorruption and Good Governance (substituting the “INAI” (Instituto Nacional de Transparencia Acceso a la Información y Protección de Datos Personales – National Institute for Data Protection) for data protection.
  • PROFECO (Procuraduría Federal del Consumidor – Federal Consumer Protection Agency) for consumer rights.
  • CNBV (Comisión Nacional Bancaria y de Valores - national banking commission) for financial services.

AI Guidance, Policies, and Strategic Frameworks 

There are no official guidelines, but some reference materials and discussion papers exist:

  • General Recommendations for the Data Use by Artificial Inteligence published by the Iberoamerican Data Protection Network.
  • Towards a Regulatory Framework for Artificial Intelligence (AI) in Mexico: Consolidated Report of the Six Thematic Roundtables 2024–2025 by the  Commission for the Analysis, Monitoring and Evaluation of the Application and Development of Artificial Intelligence in Mexico of the Senate.

International AI Standards and Guidelines 

Abovementioned documents do take into consideration international standards and guidelines. 

Forthcoming AI Legislation 

Yes on April 2025, the Federal Law Initiative for the Ethical, Sovereign, and Inclusive Development of Artificial Intelligence was published for discussion purposes.
The main objective of this initiative is to establish a comprehensive legal framework to regulate the development, use, and implementation of AI in Mexico, aligned with principles of legality, transparency, fairness, human oversight, precaution, sustainability, and full respect for human rights.
