FSR: one year of enforcement
The EU Foreign Subsidy Regulation (FSR) that has been applicable since July 2023 enables the European Commission to review subsidies granted by non-EU governments to EU and non-EU companies when they operate within the EU. It introduces three important instruments including mandatory notification tools for merger and public procurement procedures and provides for a general investigative tool to allow the Commission to initiate investigations without prior notification.
