Upcoming changes under the Employment Rights Act 2025 and the proliferation of AI tools are levelling the playing field and making employment litigation ever more complex and risky for employers. With many more employees set to benefit from new and enhanced workplace protections and the ability to access quickfire legal advice via AI tools, employers are bound to see more workplace disputes and an increase in employment litigation. Employers need to prepare to navigate this changing landscape.

Join us for a practical and engaging in-person event where CMS employment law experts will explore the new litigation playbook. The team will offer guidance on how to manage the use of AI by employees in employment disputes, manage litigation risk in 2026 and beyond and prepare witnesses for success in litigation. During the event, the team will focus on:

  • Use of AI in employment disputes and tactics for managing its use by claimants and preventing its misuse.
  • Managing litigation risk post-ERA. This will include practical and strategic ways in which HR and ER teams can seek to avoid litigation and succeed in defending claims when they arise. We will also look at how businesses can adapt senior exit strategies in light of the removal of the cap on compensatory awards, and manage the increasing restrictions around the use of non-disclosure agreements when settling claims and disputes.
  • Mock cross-examination to help demonstrate the importance of setting up witnesses for success in the tribunal and ways in which to do so.

This session will be of interest to all People/HR teams, compliance and legal professionals who are responsible for People/HR related issues and litigation. There will also be an opportunity for one to one discussions with our experts.
