Trade Mark Searches, Clearance & Risk Assessment

Our Trade Mark team undertakes national, regional and global trade mark clearance searches on a regular basis. We work with you to devise searching strategies which can often be staged to manage your budget and priorities. 

We recognise that clearance exercises can be stressful and time-critical and require creative thinking to come up with appropriate strategies. There is a broad spectrum of clearances available, ranging from single territory knock-out searches, to pan-EU and global comprehensive clearance and much in between. Clearance frequently involves common law searches looking at real world use and social media presence, and we work with experienced investigators to assess the state of the marketplace and provide advice on risks associated with unregistered uses. 

Our reports set out the risk profile for prospective brands in a digestible and commercial format, so that you and your stakeholders can easily understand risks and possible mitigation strategies. We use graphics and colour to help you visualise the risk profile of particular brands in the territories of interest. Above all, we ensure that our advice is proactive and commercial. 

We are holistic in our assessment, analysing both legal and commercial risk factors. We point clients to strategies for mitigating risks and overcoming potential obstacles to launch wherever possible. We will partner with you to do all we can to reach a positive outcome.
