Anne is a senior associate in the Infrastructure, Construction and Energy Disputes Group that forms part of our global Energy, Projects and Construction practice. 

Anne works with employers and contractors to resolve disputes across the infrastructure and construction sectors. Anne has advised a number of clients in relation to complex construction disputes, as well as high-profile infrastructure projects in the UK.

Anne also works with clients to avoid formal dispute mechanisms, through mediation or structured negotiation and engages with clients to review existing contractual arrangements, evaluate risk and reassess working practices to help avoid disputes with suppliers, contractors or sub-contractors.

Anne has recently been involved in a £100million multi-party litigation including coordinating between a team of barristers, a team of experts and CMS colleagues throughout the UK to ensure the best outcome for the client.

Relevant experience

Litigation

  • A contractor in a £140m multi-party dispute in the Technology and Construction Court relating to significant defect claims arising out of the construction of a new hospital and leading on a professional negligence head of claim against a Part 20 Defendant.
  • A sub-contractor in relation to protective injunctive proceedings, to prevent an abusive winding up petition.
  • Working with a contractor in relation to a multimillion-pound dispute in relation to construction defects, with specific focus on potential negligent design and the extended limitation period under the DPA, brought in by the BSA.
  • A sub-contractor to defend adjudication enforcement proceedings relating to interim payments, and then further advising on the merits of proceeding to arbitration in relation to the final account.

 Adjudication

  • A communications client to defend multiple simultaneous adjudications brought by a contractor in relation to payment and measurement disputes.
  • A major contractor in defending a substantial adjudication claim brought by its sub-contractors for interim payments.
  • A communications and media client to defend an adjudication brought by a sub-contractor in relation to payment, which ultimately resulted in adjudication enforcement proceedings being successfully defended.

 General dispute resolution

  • Worked with a sub-contractor involved with renovation works at Court No. 1 Wimbledon to advise on a dispute arising out of the final account and other financial entitlements arising from its sub-contract as well as advising on wider dispute strategy.
  • Providing project advisory advice in relation to a dispute for a contractor arising out of new renewable technology and successfully agreeing a settlement agreement.
  • Providing advice in respect of a dispute arising from a Government contract to avoid escalation to formal dispute procedures.
