Ben Marshall is a Senior Associate based in Sheffield and specialises in Clinical and Professional Risks with 25 years experience in the sector. He acts for a leading Medical Defence Organisation for both NHS and private clinicians and also many Private Healthcare providers – both insured and uninsured. His defence work covers a vast range of clinical practitioners, from General Practitioners, Dentists and nurses to private hospitals and clinics. Ben has worked across all areas of healthcare claims, including common areas of primary care such as delayed diagnosis of cancer, cauda equina, vascular/orthopaedics leading to amputation and prescription errors. Away from primary care, Ben has acted too for more niche specialisms such as Uroandrologists performing gender surgery, sports club medicine and bariatric surgery.
These claims involve complex medical and legal issues, often with significant value and catastrophic injury. Very often these claims attract multiple defenders where tactics are key and Ben’s knowledge and connections within the sector (having acted for the NHSR too) place him in an advantageous position to advise and achieve favourable outcomes for his clients.
Ben has also represented clinicians appearing before their regulatory body, the GMC, in particular where civil claims are pursued alongside disciplinary action. Further, Ben’s experience of practicing in Scotland (with dual qualification) has enabled him to assist clients with a presence in Scotland, recently representing clinicians in general and dental practice and also a leading private hospital.
