Simon Evans is an Of Counsel specialising in Pensions and Pensions Disputes advising trustees, employers and master trusts on funding (including alternative endgame structures), benefit issues, distressed situations, tax and investment. Simon acts on a range of pensions litigation matters, including solving benefit issues, disputes about employer liability, investment loss cases and professional negligence. Simon has acted on many high profile regulatory investigations including ‘moral hazard’ financial support direction and contribution notice cases. Simon also advises extensively on cross-border pension issues.

As he advises on both litigation and non-contentious pensions matters, Simon often acts as a problem solver for clients who can combine his experience to identify cost-effective solutions which may not be apparent to more narrow specialists. He has recently been helping schemes on how they avoid new risks when applying AI to improve services. 

Before joining CMS, Simon worked at another leading City law firm. He has also served on secondments at a major bank, an airline and a government organisation. Simon is a frequent speaker at conferences and seminars on both general pensions and pension litigation issues.

  • BT in the Court of Appeal in relation to GMP increases.
  • An investment fund from a financial support direction investigation by the Pensions Regulator relating to three schemes with a combined GBP 500m+ deficit.
  • The Atos trustee on a c.GBP 1bn merger of three schemes, including a novel contribution structure involving the purchase of French listed shares through a Scottish Limited Partnership.
  • Creating an innovative ‘stabiliser’ funding structure for the employer of a multi-billion pound scheme.
  • The House of Fraser trustees on their c.GBP 600m PPF+ wind up and buy-out.
  • On an expedited court solution to allow trustees to enter a buy-in with favourable pricing in the face of certain statutory restrictions.
  • A number of schemes on cross-border issues involving Ireland, Isle of Man, Jersey, Guernsey and Gibraltar.
  • For employers, trustees, representative beneficiaries and professional indemnity insurers on Part 8 litigation, including rectification, construction and equitable rescission.
  • An employer against a claim for specific performance under an outsourcing contract.
  • Trustees through negotiation of capital backed journey plan and superfund arrangements.
