Steph McTighe is an associate in CMS’s UK Dispute Resolution Group with in-depth experience of advising clients on a range of English law commercial disputes in the High Court and in international arbitration. Steph has recently worked on class actions and competition related work in the Competition Appeal Tribunal. Her experience includes acting for multinational and listed companies, often with a foreign law element. Steph qualified as a solicitor in 2012 and worked for US firm Quinn Emanual on the claimant side on cases worth up to £100m before spending some time at Westminster and returning to the legal profession in 2022, when she joined CMS. 

Steph is a former Chairperson of the Children’s Panel (Scotland’s juvenile justice system) and a CEDR accredited mediator. She volunteers as a mediator through the Edinburgh Sheriff Court.

Relevant experience

Litigation 

  • A pensions specialist in relation to a cyber-attack as a result of spearfishing. 
  • An insurance investment group in proceedings against RBS and Direct Line, in which it was alleged that RBS and Direct Line misused the client’s confidential banking information. Involved from issuance of claim form to trial in Chancery Division.
  • An online retailer in a series of warranty disputes arising out of business acquisitions, including serious allegations of dishonesty. Involved in supplemental witness statements, expert evidence and up to and during trial.
  • A private equity fund in a professional negligence claim against a ‘big 4’ accountant. The claim concerned the performance by the accountant of a due diligence assignment on a company acquired by the fund that later went into administration. Drafting witness statements, numerous meetings with experts re. preparation of report etc.
  • A sovereign government involved in an English High Court litigation - attending several settlement negotiation meetings with an international defence electronics company.
  • A leading debt recovery service provider related to a portfolio of distressed Polish debt. This involved issuing and serving a claim against defendants in Cayman Islands, USA and Ireland.
  • An oil exploration company in contractual dispute and drafting settlement agreement.

Arbitration

  • An American media conglomerate in a USD 80m ICSID arbitration, related to the expropriation of assets. 
  • A Turkish oil and gas company in an ICC arbitration related to a dispute over the construction of a pipeline in Turkey, arising from a Joint Operating Agreement (JOA).  The Claimant alleged that the Respondent breached the JOA in various ways. The claim was successfully defended on each point. Working with local counsel and attending arbitration hearing in Turkey. 

Competition Appeal Tribunal

  • The Defendant in an abuse of dominance claim in the CAT where the Claimant is seeking damages of USD 25m.
