Tim Malloch, an experienced and versatile lawyer, is a senior associate in the Disputes Resolution Team at CMS London.  Having studied law at Nottingham University and Nottingham Law School, Tim qualified as a solicitor in 1999, after training at Macfarlanes moved to Freshfields Bruckhaus Deringer and, as a Senior Associate, advised on corporate transactions and finance projects. 

After 7 years at Freshfields cycled from Ushuaia, Argentina to Prudhoe Bay, Alaska-a two-year trip that raised money for Médecins Sans Frontières.  He subsequently joined ClientEarth, an award-winning legal NGO, and devised a litigation strategy that helped persuade the UK Government to abandon its plans to build a new generation of coal power stations. Tim returned to private practice in 2010 and joined CMS in 2018 where he advises on a wide range of high-value commercial disputes, often with an international dimension.

Relevant experience

  • An investment manager in three disputes with a major UK bank relating to the timing of the redemption of the bank’s investment in a hedge fund.
  • The claimants in High Court proceedings involving disputed royalty payments from an iron ore mine in West Africa with estimated reserves of 1 billion tonnes.
  • A claimant in High Court proceedings challenging the legality of HMRC’s decision to set off alleged historic tax liabilities against a tax tribunal award (Emblaze v HMRC [2012] EWHC B7).
  • A company director and minority shareholder of a private security company registered in Singapore in a shareholder dispute alleging oppressive conduct by the majority shareholder.
  • A company director in a High Court claim for an alleged breach of his fiduciary duties, including advising on the potential legal sanctions in respect of the company obtaining unauthorised access to his personal email account.
  • High Court proceedings arising from a dispute between the shareholders of a private wealth management business (Signia Wealth Ltd v Vector Trustees Ltd & Ors [2018] EWHC 1040 (Ch)).
  • Professional negligence claim against counsel and a firm of solicitors arising from an application made to the Court of Protection to revoke a statutory will.
  • High Court proceedings involving a jurisdictional challenge and allegations of fraud (Privatbank v Kolomoisky and ors [2018] EWHC 3308 (Ch)).
  • A pharmaceutical company in an intellectual property dispute for largest damages inquiry ever undertaken.
  • Two Chinese companies in relation to an international shareholder fraud dispute, obtaining stop notices, interim injunctions and a Norwich Pharmacal order.
