Rectification – Decree – Licensing of private service power lines

On 21 April 2022, the Directorate-General for Energy and Geology (DGEG) published a rectification of Decree no. 5/2022, of 22 February 2022, regarding the specific licensing procedures for the licensing of private service electricity lines.

Through this rectification, the need for private service electricity lines to have a declaration of public utility to be licensed under the terms applicable to public service lines was eliminated, pursuant to Decree-Law 26852/1936, of 30 July, which establishes the Licensing Regulations for Electrical Installations (RLIE).

Therefore, it was determined that private service interconnection infrastructures are licensed as public service infrastructures, under the terms of the RLIE.

Clarification – Measurement and quantification of the energy produced by repowering

On 22 April 2022, DGEG published a clarification regarding the measurement and quantification of energy produced by repowering, regulated by Decree-Law no. 15/2022, of 14 January (DL 15/2022).

It is clarified that the repowered electricity producing centre must be equipped with the necessary and appropriate means of communication, measurement and control, for the purpose of being able to receive interruption instructions from the national electricity system global manager. 

These above-mentioned means must also allow for the autonomous quantification of the electricity produced under the guaranteed remuneration scheme or another subsidised remuneration support scheme and the electricity produced as a result of the repowering, which, in accordance with Decree-Law 15/2022, is remunerated at market prices or through bilateral contracting.

Therefore, the holder of a power plant that benefits from guaranteed remuneration for a certain period, when repowering, must guarantee the individual quantification of the electricity resulting from the award and the priority of injection into the public service electric network of all the electricity that the solar photovoltaic power plant may produce according to the defined connection power.
