Meet the Law - Reporting the employment relationship of an employee on Social Security website

As of the present date, April, 1st 2022, a new version of the "Report Employment Relationship" service is available on the Social Security website, which replaces the current "Hire an Employee" service.

The new service will be available in "Employment" > "Employee's relationship" > "Communicate employment relationship".

Social Security will provide detailed information about these changes on its website, which will be accessible in "Employer" > "Employee’s Admission". Irrespective of this, the following information may be considered:

1.    Features of the new Social Security Direct service

The new Social Security service will have the following functionalities:

  • Communication of a new employment relationship;
  • Consultation of employees' relationships;
  • Consultation of employment contracts information;
  • Cancellation of the employment relationship of the employees reported in the month in which the employment relationship was submitted;
  • Registration of employment contracts (for previously reported relationships that do not have an associated employment contract);
  • Modification of the modality of employment contracts;
  • Amendment of the employment contracts’ data previously reported;
  • Renewal of term-employment contracts already registered.

2.    Communication of Employment Relationships

As of today, in addition to the current information fields, the following fields will also have to be completed, when registering employment relationships:

Provision of work: indicate whether the provision of work is on-site or under a telework regime, based on the work provision with the highest percentage value. Note:

  • In the event that the telework regime and the on-site regime have equal percentage values, and if there is a telework agreement or an employment contract under a telework regime, the option "Telework" should be selected.  

Job category: field to be filled in accordance with the Portuguese Classification of Job categories;

Basie salary: gross monthly salary;

Work percentage: percentage of work rendered with reference to the weekly normal working period in a full-time employment relationship. Note:

  • It is a mandatory field for part-time employment contracts, being allowed to include decimal values.

Working hours: number of weekly working hours. Note:

  • It is a mandatory field for full-time or part-time contracts (weekly hours) or intermittent contracts (annual hours).

Working days: number of monthly working days. Notes:

  • It is a mandatory field for part-time employment contracts (monthly days) or intermittent contracts (in this case, the number of days to indicate will be annual);
  • In situations of part-time employment contracts, if the employee works 5 days a week, this field must be filled in with 30 days. However, if the employee works less days per week, the proportional value must be filled in.

Employment contract justification: list available for selection, based on the term employment contracts justifications as foreseen in the Portuguese Labour Code. Note:

  • It is a mandatory field for term employment contracts.

Seniority allowance: only to be filled in when applicable.

3.    "Consult Employees"

Through the option "Consult Employees", the employer may update the information concerning the last employment contract of the employees at its service, as well as the base salary of the employees (provided that no other changes to the remaining data of the employment contract exists).

4.    “Update of employment contracts"

Between April, 1st 2022 and December 31st, 2022, the employer must update and record the data of active employment contracts already reported to Social Security (on a date prior to April 1st, 2022) through the "Consult Employees" field, in order to updated the information regarding these employment contracts.

Such update should be carried out individually.
