Hamburg - The Japanese energy investment company Daiwa Energy & Infrastructure Co. Ltd. has acquired 40 percent of the shares in Aquila Capital Holding GmbH (together with its subsidiaries "Aquila Capital"), a leading manager in the field of real asset investments. The share purchase agreement, which was signed in November last year, was consummated last week.
An international CMS team led by the joint lead partners Dr. Holger Kraft and Dr. Eckart Gottschalk provided comprehensive legal advice to Daiwa Energy & Infrastructure on the acquisition of the shares, including the due diligence process and the negotiation of the shareholder agreement. The advice also included the application for and obtaining of numerous regulatory clearances. This marks the first transaction by Daiwa which is accompanied by CMS.
