Felix Fuchs specialises in the enforcement of and defence against insolvency-related claims (pre-litigation and litigation), including liability claims against managing directors, board members and supervisory board members of insolvent companies, e.g. for delayed insolvency filing, restitution claims under insolvency avoidance law and claims for damages against lawyers, tax advisers and auditors for breach of duty in the run-up to insolvency. With long-standing experience both in asserting such claims on behalf of insolvency administrators and in defending against them, he represents his clients in court and conducts out-of-court negotiations with opposing parties as well as liability and D&O insurers.
Felix also focusses on cross-border litigation, advising foreign creditors on insolvency proceedings in Germany and asserting claims abroad for German creditors and German insolvency administrators in cooperation with local colleagues. If several countries need to be considered, he manages and oversees a corresponding coordinated approach.
After serving two years as a judge, Felix joined CMS in 2016. Three years later, he was seconded to CMS Rui Pena & Arnaut in Lisbon and was appointed counsel and principal counsel in 2022 and 2025 respectively. Felix regularly publishes in professional journals and has authored articles in several commentaries and handbooks.
