Scotland is currently consulting on the introduction of opt‑out class actions – where class members would automatically be included in any action, without signing up to participate. If implemented, this would mark the most significant shift in Scottish litigation risk in decades, with potential implications across the UK and Europe. Countries that have introduced these mechanisms have faced very large upticks in class actions, with significant risks for business.
CMS Scotland, CBI Scotland, The Fraser of Allander Institute and The David Hume Institute invite you to join us for a half‑day conference to explore these issues with Scottish business leaders, in-house lawyers, academics and economists. There is a limited time for business to influence the debate.
