The risks of losing and having to pay the hefty costs of litigation are well known. But litigation can have vastly greater consequences for the reputations of the individuals and organisations involved in the dispute.  The matter value in the case can be dwarfed by the reputational damage done to the parties.

Allegations can be made by both sides and can be pounced upon and reported by the press. Information capable of causing catastrophic reputational damage can become publicly available at many points in the life of a big litigation, and with devastating consequences. Highly confidential or private information may be relevant to the dispute and may need to be disclosed. A Judge may make serious findings against an individual who is not a party to the litigation, including the lawyers on either side.

The session will be chaired by Clive Coleman (former BBC Legal Affairs Correspondent and now Senior Partner at Maltin PR), with CMS experts Tamsin Blow and Louise Boswell and Litigation PR expert Tim Maltin (Managing Partner at Maltin PR).  We will address the key points of reputational risk during litigation and what can be done to mitigate them, including:

  • information, it's availability and use in litigation;
  • reputational issues in judgments and adjudications; 
  • privacy in criminal proceedings; and
  • the importance of PR in litigation
