The CMS Employment Group, which is made up of the employment teams within the nine CMS European law firms, recently completed "Cross-Border Transfers and Redundancies", a practical guide to managing the employment aspects of business transfers and re-organisations across different European jurisdictions. The book analyses cross-border transfers and redundancies in a coherent and practical way from a European-wide perspective as well as at a national level.
"Cross-Border Transfers and Redundancies" consists of four parts. The first part considers the common legal and regulatory framework that has been established across the European Union, dealing with the current position in relation to business transfers, collective redundancies, the information and consultation of employees and jurisdictional and conflicts of laws issues. The second part of the book consists of the principal pieces of European legislation in relation to these issues, which are reproduced in full.
The lawyers within the CMS Employment Group have used their knowledge of the difficult employment law-related issues that commonly arise in relation to cross-border transfers and re-organisations in practice to create three case studies, which make up the third part of the book. The fourth and longest part of the book consists of country-by-country guides that allow the reader to compare and contrast the different approaches that have been taken to implementing the common legal framework in the different European jurisdictions and to see the effect this has in practice. In addition, each CMS firm has produced a response to the case studies from its own national perspective.
