Existing Regulatory Frameworks Applicable to AI
Existing laws having an impact on Artificial Intelligence Systems:
Computer Misuse and Cybercrimes Act - This Act provides for the protection of critical information infrastructure and creates obligations for owners or operators of a system designated as critical infrastructure. It will apply to AI systems to the extent that these systems will be categorised as critical information infrastructure.
Consumer Protection Act, 2012 – Relevant to the extent of the need to protect consumers who use Artificial Intelligence products and systems.
Data Protection Act, 2019 – Relevant to the extent that, among other matters, every data subject has a right not to be subject to a decision based solely on automated processing, including profiling, which produces legal effects concerning, or significantly affects, the data subject.
Regulatory Oversight of AI
There is currently no regulatory oversight of AI in Kenya.
AI Guidance, Policies, and Strategic Frameworks
The Kenya Artificial Intelligence Strategy 2025-2030 was launched in March 2025. This was prepared by the Ministry of Information, Communication and Digital Economy.
The Draft Information Technology Artificial Intelligence Code of Practice. The focus of this Code is to protect the rights of citizens during the development of Artificial Intelligence systems. It has been developed by the Kenya Bureau of Standards. The Code, released in 2024, is yet to be finalised and gazetted as a Legal Notice.
The Kenya Robotics and Artificial Intelligence Bill, 2023. This was developed by the Robotics Society of Kenya. Its focus is the development of a framework to regulate use and adoption of Artificial Intelligence. This is still in Draft Form and has not made any headway in the legislative process.
International AI Standards and Guidelines
As shared, Kenya has no specific laws or regulations expressly covering Artificial Intelligence.

Artificial Intelligence law and regulations are in development pursuant and in line with the ambition set out in The Kenya Artificial Intelligence Strategy 2025-2030.
