Tech and Sourcing

CMS Kluge is renowned for participation in large digitalization and sourcing projects for both public and private clients. We have extensive experience with commercial negotiations and licensing/subscription models regarding software, cloud computing and other as a service deliverables. Members of CMS Kluge’s practice group are experts on the Norwegian ICT template agreements. Especially the widely used SSA template agreements, which are the government standard terms and conditions for ICT contracts. Our lawyers have even on several instances contributed to the development and official guidance text on the SSA agreements on assignment from the government entity that manages the portfolio. We are also experienced in negotiations and contract drafting in R&D projects where rights to the developments and data are key factors. Our lawyers have both theoretical and practical experiences when it comes to big data and artificial intelligence. 

Furthermore, the practice group handles matters concerning eCommerce, IoT, e-Communications and telecom, eSignatures, infrastructure, cybersecurity and other legal compliance and regulatory issues in the tech field. We also have an unique specialisation within accessibility matters concerning technology. 

We have a strong presence within the mobility/auto tech sector, having assisted on several projects concerning autonomous driving, eTicketing, smart mobility, mobility as a service, electrification, intelligent transport systems and other developments in this field.

Media and Entertainment

Our practice group is highly skilled within the Media and Entertainment field.  CMS Kluge represents the majority of the recording industry in Norway by being head of legal and lobbying for IFPI Norway, and represent IFPI Norway towards IFPI International. In addition to deep knowledge of the music industry, we are legal advisors to several book publishers and producers within audiovisual works. 

Within Media and Entertainment we have thorough knowledge of copyright, in addition to long experience with the business affairs of the industries involved. Further we have deep knowledge to adjacent relevant legal fields within the IP area like trademark and designs, and the commercial aspects of the industry, including the full agreement park and the cash flows of the clients involved in the industry.

Our practice group also handles matters concerning gambling, sports, eSports and culture; such as museum exhibitions and other events.

Technology Transformation – Media
The media sector is known to be highly competitive, with that competition driving innovation. Older media businesses have had to grapple with disruptive new entrants. And those new entrants are constantly working to deliver better and more engaging content and user experiences to maintain their advantage. Digitisation has changed how media companies interact with their audience in ways we could not have imagined just a few years ago, but this comes with risk. This report is a deep dive into the data first produced for the report Technology Transformation: Managing Risks in a Changing Landscape. This saw over 500 corporate counsel and risk managers surveyed from multiple industries across the world. Here we look in detail at the 75 respondents from the media sector, and their perspectives on the risks associated with busi­ness-crit­ic­al technologies, including emerging technologies. What did we find? Media is a dynamic sector and can be an early adopter of many novel technologies as companies push for competitive advantages to create and satisfy customer demand. As we look to the future, the sector does seem underprepared in some areas, which is a potential cause for concern.
