Public litigation is often triggered by measures that directly affect business operations and budgets. Typical examples include tax assessments, recovery of state subsidies, information requests, or the refusal or withdrawal of licences. Decisions in planning and permitting can also determine whether an infrastructure or life sciences project proceeds on schedule.

We support companies in defending their position in administrative court litigation and related public law proceedings. We assess the procedural situation early, secure interim relief where needed, and build a litigation strategy that reflects both legal remedies and commercial impact. In representative actions relating to planning approval decisions or existing authorisations, we also defend administrative decisions in close cooperation with the public bodies concerned. This gives us a clear view of both the company perspective and the decision-maker’s perspective.

Court practice across administrative, fiscal and social jurisdictions

Our public litigation experts have extensive experience in proceedings before the administrative courts (Administrative Court, Higher Administrative Court/State Administrative Court and Federal Administrative Court) as well as the social and fiscal courts in all three instances.

We advise and represent clients in all types of action, with a particular focus on judicial review and interim relief (summary proceedings) where time is critical. Sector work frequently involves mobility, life sciences & healthcare and infrastructure. Our team includes litigation lawyers who regularly attend hearings and who develop and implement strategies in complex factual and regulatory settings. We keep the litigation pathway, the evidence position and the commercial consequences in view throughout.
