Protection against Insolvency of a Customer or Supplier

In today’s economically challenging times, it is crucial for companies to protect themselves against the risk of their customers or suppliers becoming insolvent. As experienced restructuring and insolvency experts, we assist you in protecting your business relationships as effectively as possible, including by taking preventive measures.

Detecting early signs of insolvency

Our experts are trained to recognise early signs of insolvency. By carefully analysing the financial situation of your business partners, we are able to identify warning signs in good time, thereby allowing you to take proactive measures to secure your claims.

Legal protection for your contracts

When designing contracts with customers or suppliers, we advise you on how to best protect your rights. We review your contracts for potential weaknesses and develop customised solutions to minimise your insolvency risk, either through security deposits, retention of title or other legal remedies.

Professional claims management

If, despite all the precautions taken, your business partner becomes insolvent, we provide support for professional claims management. We represent your interests vis-à-vis the (provisional) insolvency administrator and rigorously pursue your claims. This ensures you have the best possible protection in the event of insolvency.

Notification obligations for rights of separation and segregation

We provide you with advice on all aspects of your notification obligations regarding rights of separation and segregation. We also ensure that you provide all relevant information to the (provisional) insolvency administrator in a timely fashion, thus fully protecting your rights.

Going-concern agreements with the (provisional) insolvency administrator

We also provide support around negotiating and implementing going-concern agreements in order to maintain business operations even if a customer or supplier becomes insolvent.
