The Commission has published a Green Paper proposing a Community Patent. The Commission has decided that the Community Patent Convention will not come into force and that a new initiative is needed. The most pressing concerns are the cost of translations, the need for effective courts able to consider validity and infringement together, and the problems of exhaustion.
