Spectrum at the House of Lords - the judges announced
The names of the Lords who will hear the case of Re Spectrum Plus Limited in the House of Lords have been announced. They are the lords Nicholls, Steyn, Hope, Walker, Brown and Scott and Baroness Hale. The case will be heard on 26 -28 April 2005 and we understand the judgment will be issued in late June or early July.
It will be the House of Lords who finally determine whether the charge in the bank's debenture over Spectrum Plus Limited's book debts creates a fixed or a floating charge. In May, the Court of Appeal reversed the first instance decision and found that the charge was fixed and not floating.
