Anita is a Senior Associate in the UK construction team, with a specialised focus on contentious construction matters. She provides advice to prevent and resolve complex construction disputes across a diverse client base. Her experience includes working with fund managers, institutional investors, developers, employers, contractors, and consultants, on a wide array of issues stemming from construction contracts (both standard form (including NEC, JCT, SBCC) and bespoke contracts), collateral warranties and professional appointments. 

Anita is proficient in all forms of dispute resolution, including adjudication, arbitration, litigation and mediation. Her work spans across various sectors including commercial developments (hotels, student accommodation, conference centres and offices); infrastructure (road and bridge projects); and PFI projects (waste to energy facilities). Anita uses her broad sector knowledge to guide clients through challenging construction disputes. Her commercial mindset, coupled with a pragmatic approach to dispute management, ensures that Anita consistently delivers solutions that align with her clients’ business objectives and project needs. 

Anita is co-chair of Young Mediators Group.

Relevant experience

  • Pursuing and defending fire safety claims in the Court of Session for developer, investor, tenant and contractor clients.
  • A contractor client in a multi-million pound delay and disruption claim during the renovation of a historic building, successfully negotiating a favourable settlement through extra-judicial discussions. 
  • A local authority on its complex operational waste PFI contract. Pursuing numerous adjudications arising from the performance (and non-performance) of the contract. Defending a complex adjudication in respect of the insurance provisions contained within the contract.
  • A publicly owned large entertainment and performance venue following defects being discovered within its performance space. Anita advised in relation to the court action whilst also advising on the practical management of the remedial works tender process and operational constraints within the venue.
  • A construction, equipment and support services sub-contractor under a bespoke Sub-Contract Agreement, in the successful defence and ultimate settlement of an Arbitration relating to delay, defects and termination claims amounting to circa £208m in respect of a Renewable Energy and Recycling Plant project.
  • A main contractor in a dispute with Building Services Engineers under a novated NEC 3 Professional Services Contract in respect of defects in the chiller and air conditioning units and domestic hot water installation following refurbishment and alteration work carried out at a University.  Other claims under the same project include pursuing the University for payment in respect of the contractor’s entitlement under certain contract provisions arising as a result of the COVID-19 pandemic.
  • Enerveo Ltd in pursuing a claim for circa £6m in relation to compensation events which caused delay and disruption to the M&E improvement works on the West Anglian Main Line at Northumberland Park Station and Tottenham Hale Station.
