On July 13, 2023, DGEG published Order no. 30/2023 on the procedure to be adopted in the licensing of renewable hydrogen production.

Considering the recent amendments on the European framework regarding the production of renewable hydrogen – in particular the adoption by the European Commission of two delegated acts of the Renewable Energy Directive (Directive no. 2018/2001, of the European Parliament and the Council) approved on the 10th of February 2023 – DGEG now establishes a procedure to verify that the hydrogen produced by a certain installation may be considered as renewable hydrogen for the purposes of the delegated acts.

Applications for the licensing of installations for the production of renewable hydrogen must be completed with the declaration through which the applicant declares:

  • Compliance with the requirements for the use of energy from renewable sources, under the terms of the Renewable Energy Directive;
  • Compliance with the requirements established on the delegated which are necessary to ensure the renewable origin of hydrogen;
  • Monitoring the entry into force of the requirements foreseen in the delegated acts, ensuring their compliance as soon as they are applicable.

Subsequently, to obtain the «digital title for the installation and operation of the industrial establishment», in the context of the industrial licensing, the applicant, where applicable, shall provide the following documents:

  • Evidence of connection between the renewable electricity production and the electrolyser; or
  • The contract for the purchase of renewable energy; and
  • The information necessary to evidence compliance with the commitments made in the aforementioned declaration.

  • ERSE approves regulatory review of the electricity sector

On the 17th of July, ERSE approved the regulatory review of the electricity sector, following the public consultation process that took place between the 28th of March and the 31th May 2023.
