CMS advises frozen food specialist GETI WILBA on acquisition of apetito convenience

Berlin – GETI WILBA Holding, a company specialising in frozen products, has acquired the business operations of apetito convenience AG & Co. KG. The buyer is a portfolio company of equity fund CMP German Opportunity Fund III. Acquiring the convenience food firm will enable GETI WILBA to expand its role as a specialist in frozen meals. The aim going forward is to unlock the potential of new product lines and markets, and to drive product innovation.

The transaction is subject to various closing conditions and to approval by the competition authorities. The parties agreed not to disclose details.

A CMS team headed by lead partners Dr Eva Annett Grigoleit and Dr Igor Stenzel advised GETI WILBA Holding on all legal aspects of the transaction. This included advising on relevant aspects of food law. In-house legal support for the transaction was provided by general counsel Dr Robert Thamm. CMP is a longstanding client of CMS Germany and is regularly advised by CMS on company acquisitions and disposals in particular. Last year, the team advised CMP German Opportunity Fund III on all aspects of acquiring the business operations of GETI WILBA GmbH & KG.
