Data risk is a key risk for any business. The potential consequences of an infringement of data protection law are severe, both in terms of regulatory action and potential litigation including class actions. In this session, partners from our Technology, Insurance and Disputes teams will look at recent developments and consider the future outlook in this fast-moving area.
- Duncan Turner will consider what the regulatory outlook is in light of proposed reforms to the legal framework post-Brexit and the appointment of the new Information Commissioner;
- Amit Tyagi will discuss recent developments in cyber insurance, including recent changes to coverage, issues arising from war and other force majeure events and cases addressing “nuisance” data breach claims; and
- Kenny Henderson will reflect on recent court decisions on data-themed class actions and consider what the likely direction of travel is in this space.
